Driving Under the Influence Case File on the desk of Lawyer Michael Kotik

Driving Under the Influence (DUI) — also referred to as DWI (Driving While Intoxicated) or OWI (Operating While Intoxicated) depending on jurisdiction — is a serious offense in both Pennsylvania and New Jersey. It involves operating or being in actual physical control of a vehicle while impaired by alcohol, controlled substances, or both.

In both states, laws establish minimum blood alcohol concentration (BAC) thresholds (e.g. 0.08%) but impairment can be proven even at lower levels if driving ability is compromised. Multiple factors matter: the driver’s BAC, prior DUI history, whether drugs were involved, whether injuries or accidents occurred, and whether the vehicle was commercial or used for school or public transport.

DUI convictions can lead to license suspension or revocation, fines, mandatory education courses, installation of ignition interlock devices, criminal penalties including jail time, and long-term impact on insurance and employment.

Statutory Definitions & Penalties – Pennsylvania vs. New Jersey

IssuePennsylvaniaNew Jersey
Statute / Legal BasisPA’s DUI law is codified at 75 Pa. C.S. § 3802, which prohibits driving or being in actual physical control of a vehicle while impaired or when one’s BAC meets certain levels within two hours. New Jersey’s DWI statute is found at N.J. Stat. § 39:4-50, making it illegal to operate a vehicle while under influence of liquor, narcotic, or with BAC ≥ 0.08.
BAC Levels / Tiers– General Impairment: BAC ≥ 0.08% but < 0.10%
– High Rate of Alcohol: BAC ≥ 0.10% but < 0.16%
– Highest Rate: BAC ≥ 0.16% or more
– Also prohibits driving under influence of drugs or combination of alcohol + drugs
– Special rules for minors, commercial, school vehicles.
In New Jersey, BAC ≥ 0.08% makes a driver legally intoxicated. A driver may be charged even below 0.08% if performance is impaired. Additional tiers may invoke enhanced penalties (e.g., BAC ≥ 0.10%, or ≥ 0.15%) and mandatory ignition interlock laws.
Penalties for First Offense (Typical Range)• Misdemeanor (ungraded)
• Fine: ~$300
• License suspension: 12 months (depending on BAC level)
• Jail: 48 hours to 6 months (depending on level)
• Alcohol highway safety school, treatment, ignition interlock program.
• Fine: about $250–$400
• Imprisonment: up to 30 days
• License forfeiture until IID installed
• Mandatory IDRC (Intoxicated Driver Resource Center) hours
• Insurance surcharges, IID requirement, other fees
• Enhanced fines/penalties for higher BAC levels.
Repeat Offenses / Enhanced PenaltiesPenalties increase with prior DUI convictions: greater fines, longer licenses suspensions, more jail time. High BAC or drug involvement can trigger higher grade charges (First Degree misdemeanor in some contexts). New Jersey’s law escalates penalties: mandatory minimum jail time, longer license suspensions, longer IID periods, and enhanced fines. Statutory amendments (e.g., for BAC ≥ 0.15%) have further tightened mandatory rules.

What Lawyer Michael Kotik Can Do

Facing a DUI / DWI charge can feel daunting—but having a skilled defense attorney early can significantly improve your outcome. Michael Kotik can assist by:

Scrutinizing the traffic stop and arrest procedure—whether law enforcement had reasonable suspicion or probable cause, whether testing was conducted properly, and whether your rights were respected.

Challenging chemical testing — questioning calibration, maintenance records, chain of custody, delay issues (the two-hour rule), and refusal consequences.

Offering alternative defense strategies — whether negotiating reduced charges, seeking dismissal under problematic evidence, arguing impairment below legal threshold, or leveraging treatment / diversion options.

Representing you in court, cross-examining witnesses, presenting expert testimony (e.g. toxicologists), arguing suppressions or constitutional violations.

Negotiating favorable sentencing conditions when conviction is likely — minimizing incarceration, arranging for alternative programs (rehab, community service, treatment), and advocating for shortest license suspensions or mitigations.
